2. Service Description

Thoraia.com provides:

  • A unified inbox for WhatsApp Business messages
  • Incoming message management
  • Reply functionality through WhatsApp Business API

We do NOT provide:

  • Outbound bulk messaging tools
  • Unapproved marketing automation
  • Spam messaging capabilities

3. Role Definitions

  • You = Data Controller
  • Thoraia.com = Data Processor
  • Meta = Independent messaging infrastructure provider

4. User Obligations

You agree to:

  • Use the platform only for lawful business communication
  • Ensure customer consent where required
  • Comply with WhatsApp/Meta policies
  • Avoid misuse, spam, or unauthorized automation

5. WhatsApp Restrictions

You acknowledge:

  • You cannot send unsolicited messages
  • Messaging is restricted to inbound replies only
  • Meta may enforce limitations outside our control

6. Prohibited Activities

You must NOT:

  • Use the platform for spam campaigns
  • Scrape or export data unlawfully
  • Attempt to bypass WhatsApp restrictions
  • Share access with unauthorized users

7. Data Ownership

  • You retain ownership of your data
  • We process data strictly on your behalf
  • We do not claim rights over message content

8. Service Availability

We do not guarantee uninterrupted service due to:

  • WhatsApp API downtime
  • Meta policy changes
  • External infrastructure issues

9. Limitation of Liability

We are not liable for:

  • WhatsApp delivery issues
  • Account restrictions by Meta
  • Data loss caused by third parties
  • Indirect or consequential damages

10. Suspension & Termination

We may suspend or terminate accounts if:

  • Terms are violated
  • Meta policies are breached
  • Security risks are detected

11. GDPR Compliance

We comply with GDPR and act as a Data Processor.You are responsible for ensuring lawful basis for collecting and messaging your customers.

12. Governing Law

These Terms are governed by applicable EU regulations and the laws of the hosting jurisdiction.
